Privacy Policy

This Privacy Policy explains how we (“Anglo French Properties Ltd”) will use your personal information. For the purposes of data protection legislation, we are the data controller and also use third parties to process your data on our behalf.

1 – Storage and use of information

Anglo French Properties requires personal information to interact with our clients, produce contracts and respond to our clients’ enquiries and fulfil the bookings made with us. As such we process the following information:

  • Contact information: To communicate with clients regarding their requirements and preferences, send contracts, organise subsequent booking arrangements and send any booking information to the property owners or their managers. Contact information is also stored to identify inbound communications, to authenticate clients when they contact us and may also be used in emergency situations if necessary. E-newsletters are sent out to those who have submitted an enquiry, specifically expressed interest in receiving information from Anglo French Properties LTD, or signed themselves up, unless they actively choose to opt out. From time to time, we may send out direct mail (such as our brochures, leaflets or other Anglo French Properties collateral) to those who have submitted an enquiry, specifically expressed interest in receiving information from Anglo French Properties, or signed themselves up, unless they actively choose to opt out. Information is collected online to enable us to expedite the information requested. This may include a request to join our e-newsletter list, receive a brochure, enter a competition or prize draw, make an enquiry or submit a booking form.
  • Payment information: In order to return security deposits and to make refunds if required
  • Any other details you provide about yourselves that you deem important for us to know in the process of taking or recommending properties: to ensure that your booking is the best fit for the lead tenant and the group as a whole.

If we ask you to provide any other personal information not described above, then the personal information we will ask you to provide and the reasons why we ask you to provide it, will be made clear to you at the point we collect that information.

  • Information that we collect automatically:
    We may also collect certain information automatically from your device. In some countries, including countries in the European Economic Area, this information may be considered personal information under applicable data protection laws.
    Specifically, the information we collect automatically may include information like your IP address, device type, unique device identification numbers, browser-type, broad geographic location (e.g. country or city-level location) and other technical information. We may also collect information about how your device has interacted with our website, including the pages accessed and links clicked.

Collecting this information enables us to better understand the visitors who come to our website, where they come from, and what content on our website is of interest to them. We use this information for our internal analytics purposes and to improve the quality and relevance of our website to our visitors. Some of this information may be collected using cookies and similar tracking technology, as explained further under the heading “Cookies and similar tracking technology” below.

2 – Legal Basis & Purposes for which we will use your personal data

We have set out below a description of all the ways we plan to use your personal data, and which of the legal bases we rely on to do so.

Performance of our contract with you
To register you as a new client and enable us to complete and accommodate your booking. When you make a booking you provide Identity, Contact data and also any further information in relation to your requirements which may include special category data in terms of dietary information or any disabled access needs you may have at the villa. You also have to provide information about those travelling with you.
To manage payments, fees and charges in connection with your booking.
Legitimate interests
If you have entered into a contract with us then we may use your Identity and Contact data to contact you to tell you about similar products which we think may be of interest to you.
To collect and recover money owed to us.
Legal obligation
We also rely on the legal or regulatory obligation ground to process your data in some circumstances. This means processing your personal data where it is necessary for compliance with a legal or regulatory obligation that we are subject to.

3 – Marketing

We will only retain and use your personal data for marketing purposes where you have specifically consented to this or we are permitted to do in accordance with data protection laws (including as set out below).

We may send you e-mail marketing where we comply with the Privacy and Electronic Communications (EC Directive) Regulations 2003 (PECR). PECR permits us to e-mail you information about the holiday services we offer where you have previously provided us with your e-mail address in the course of entering into a contract with us for holiday / travel arrangements or negotiations for such arrangements and we wish to e-mail you marketing material about our similar services or products. You will of course be given the opportunity to opt out of receiving such e-mail marketing communications when you first provide us with your e-mail address and whenever we send you any e-mail marketing.

Where you have previously requested or agreed to receive information about our travel services from us by post, we may continue to send you such information in the same way until you ask us not to (which you can do by telephone, e-mail or post). Everything we send you will tell what you should do if you no longer wish to hear from us. We will send you this information as this is necessary for the purposes of our legitimate interests in communicating with you unless it is or becomes clear that our interests are overridden by your interests or fundamental rights and freedoms in which case we will cease communicating with you.

We will only retain and use your personal data for marketing purposes where you have specifically consented to our doing so.
You may provide your consent to receiving marketing information from us by opting to receive marketing material either on-line or by telephone. You may also choose in what ways you are happy to receive communications from us. You may, for example, be happy to receive information and offers by post and e-mail but not by telephone.

You can withdraw your consent to receiving marketing material or other communications from us, either generally or in any particular way, at any time by e-mailing us at [email protected]. Alternatively you can telephone us.

Promotional offers from us

We may use your Identity, Contact, Technical, Usage and Profile Data to form a view on what we think you may want or need, or what may be of interest to you if you have entered a contract with us. This is how we decide which products, services and offers may be relevant for you (we call this marketing).

You will receive marketing communications from us if you have purchased goods or services from us and, in each case, you have not opted out of receiving that marketing.

Opting out

You can ask us to stop sending you marketing messages at any time by following the opt-out links on any marketing message sent to you or by contacting us at any time.
Where you opt out of receiving these marketing messages, this will not apply to personal data provided to us as a result of a service purchase.

4 – Disclosures of your personal data

We may have to share your personal data with the parties set out below for the purposes of carying out fulfilling our contractual duties.

External Third Parties:
Owners of or agents for villas who may be based inside or outside of the UK to facilitate your booking.
Service providers based in the UK who provide IT and system administration services.
Professional advisers including lawyers, bankers, auditors and insurers based UK who provide consultancy, banking, legal, insurance and accounting services.
HM Revenue & Customs, regulators and other authorities based in the United Kingdom who require reporting of processing activities in certain circumstances
Third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy notice.
We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

5 – Data security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

6 – Data retention

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

By law we have to keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) for six years after they cease being customers for tax purposes.

In some circumstances we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

7 – Your legal rights

Under certain circumstances, you have rights under data protection laws in relation to your personal data.

Request access to your personal information (commonly known as a “data subject access request”). This enables you to receive a copy of the personal information we hold about you and to check that we are lawfully processing it.

Request correction of the personal information that we hold about you. This enables you to have any incomplete or inaccurate information we hold about you corrected.

Request erasure of your personal information. This enables you to ask us to delete or remove personal information where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal information where you have exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

Object to processing of your personal information where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms . You also have the right to object where we are processing your personal information for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.

Request the restriction of processing of your personal information. This enables you to ask us to suspend the processing of your personal data in the following scenarios: (a) if you want us to establish the data’s accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

Request the transfer of your personal information to another party.

Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

No fee is required
You will not have to pay a fee to access your personal data (or to exercise any of the other rights).

What we may need from you

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Under the terms of the current Data Protection legislation, you can request a copy of the details we hold and process about you on our internal systems and that is being processed by Third Parties on our behalf.
